General terms and conditions of business
1. Parties and object of the contract
“Dine in Style” provides cooking services for occasions according to the individually concluded contract with the customer and the present general terms and conditions.
“Dine in Style” is entitled to involve third parties for fulfilling the agreed services.
2. Formation of the contract
“Dine in Style” submits a detailed offer to the customers based on its order. After examining the offer by the customers and after incorporating its possible changes and additions, “Dine in Style” places a written order confirmation of the customer. The contract is concluded with the signing of this order confirmation by the customer.
3. Infrastructure
The customer or the person commissioned by it is responsible for the fact that the infrastructure to be organized for the occasion such as the use of the kitchen and kitchen appliances as well as warm and cold flowing water, electricity and connections, direct access, lift, etc. Prerequisite by «Dine in Style». She is obliged to inform “Dine in Style” immediately, at the latest after checking the offer (see above number 2), if and to what extent this should not be the case.
Approval such as the parking permit for the vehicles from the “Dine in Style” team, concessions, suisa fees, etc. gets customers at their own expense and has to bear all associated requirements.
If the “Dine in Style” is provided by return material (glasses, dishes, cutlery, laundry, decoration, etc.), the customer is responsible to return it completely and undamaged. Losses and damage can be invoiced by customers for a new value.
4. Members of defect, liability and insurance
Customers are obliged to report defects in the agreed services immediately, and if this is not possible at the latest within 2 calendar days after the occasion.
Claims for damages against “Dine in Style” or their employees or vicarious agents are excluded if they are not based on intent or gross negligence. Liability for consequential damage is excluded in any case.
The customer or the person commissioned by it is responsible for the fact that the event that is common for the event to be organized will be completed in good time and with sufficient coverage.
5. Deria and loyalty
“Dine in Style” is active as a representative of customers and maintains their interests to the best of our knowledge and belief. It attaches great importance to the careful and timely provision of cooking services, in particular also on the quality of the dishes. She also undertakes to protect customers’ business secrets.
6. Mental property
Customers expressly recognize the sole intellectual property of “Dine in Style”, in particular the copyright of everyone in the course of cooperation. (Concepts, suggestions for menu, decoration and design, texts, pictures, graphic work, etc.)
7. Changes food/drinks
After the contract is concluded, change requests of the customers are taken into account in relation to food and/or drinks if they are communicated in writing at the latest up to 10 working days before the occasion and their implementation for “Dine in Style”.
8. Change of the number of participants
Customers can reduce the agreed number of participants by a maximum of 15% by a written notification to “Dine in Style” at the latest with a written notification to “Dine in Style”, whereupon “Dine in Style” in turn reduces the remuneration accordingly.
9. Effective number of participants
Customers must inform any deviations from the agreed or the number 8 number 8.
If the effective number of participants is higher than agreed or communicated according to Section 8, the remuneration is increased accordingly. If fewer participants are present, the agreed or communicated number of participants is relevant for the remuneration.
10. (Partial) cancellation
In the event of a partial cancellation of ≥ 20% of the agreed services (without crediting section 8), «Dine in Style» has the right to in turn withdraw from the entire contract at no cost.
If the customer resolves the contract in whole or in part, «Dine in Style» can invoice the cancellation services as follows:
· Preparation work already executed as well as specially ordered or manufactured materials, devices and accessories.

· Up to 21 calendar days before the occasion:
Processing fee à CHF 300.00
· Up to 12 calendar days before the occasion:
50 % of the canceled services
· From 7 calendar days before the occasion:
100 % of the canceled services
11. Payment modalities / aconto payment
All prices are given in CHF.
After carrying out the event, the customers receive a detailed invoice from “Dine in Style”. This is payable within 30 calendar days from the invoice date. In the event of a delay in payment, “Dine in Style” calculates a default interest of 5% of the invoice amount.
“Dine in Style” will invoice the customer of up to 50% of the order volume in advance according to the order confirmation.
A flat fee of CHF 300 is charged per assignment.
12. Applicable law, place of jurisdiction
Swiss law can only be applicable to the legal relationship between «dine in style» and customers. Lucerne is exclusive for all disputes growing from the cooking service by “dine in style”.
